Arrest of Driver under the Influence of alcohol

Whilst on routine foot patrol, officers from Northolt West End Safer Neighbourhood Team were alerted by a member of the public to a male observed sitting drinking in his car. The officers questioned the suspect, and were satisfied that his behaviour gave sufficient grounds for arrest under Section 4 of the Road Traffic Act 1988. The male was subsequently transferred to a Police station, where a breathalyser test showed alcohol levels above the legal limit.

It is important to remember;

Section 4 of the Road Traffic Act 1988 in the UK makes it an offence to drive or attempt to drive, or be in charge of, a motor vehicle when unfit to do so through drink or drugs. You can still be breaking the law if the vehicle is stationary.

Even a small amount of alcohol increases your risk of being involved in an incident.

Legal limits can be very difficult to judge, and there are many factors which affect how much an individual can drink and stay under the legal limit of 35 micrograms of alcohol per 100 millilitres of breath.

The only safe option is to avoid alcohol completely if you in charge of a vehicle.
